GTMFlex Terms & Conditions

Welcome to GTMFlex (“we”, “us”, “our”). By accessing our website or using our services, you agree to these Terms & Conditions. If you do not agree, please do not use our website or services.

1. About GTMFlex

GTMFlex provides technology and marketing execution services such as website development, landing pages, tracking setup (GA4/GTM/CAPI), paid media support, CRO, SEO, reporting and related consulting.

2. Eligibility

You confirm that you are legally able to enter into a contract in your location and that any information you provide is accurate.

3. Scope of Services

• Services are provided as per the plan, proposal, statement of work (SOW), or written confirmation (email/WhatsApp).
• Deliverables, timelines and “what’s included” can vary by plan and workload complexity.
• We may decline or pause requests that are unclear, outside scope, unlawful, or technically risky.

4. Client Responsibilities

To deliver work smoothly, you agree to:

• Provide timely access to accounts, assets, content and approvals.
• Ensure you have rights/permissions for logos, creatives, brand assets and data you share.
• Review deliverables and provide feedback within a reasonable time.

Delays in access or approvals may impact timelines.

5. Revisions & Approvals

• Reasonable revisions are included unless otherwise agreed.
• Once you approve a deliverable, later changes may be treated as a new request or separate scope.

6. Payments & Billing

• Fees are charged as per the selected plan/proposal.
• Payments must be made on time to keep work active.
• Late payments may result in paused work and access restrictions until dues are cleared.
• Taxes (if applicable) are additional.

7. No Guarantee of Results

Marketing performance depends on many external factors (budget, market, product, pricing, competition, tracking limitations, platform policies). While we follow best practices, we do not guarantee specific outcomes like revenue, ROAS, leads, rankings, or conversion rates.

8. Third-Party Tools & Accounts

You may need third-party tools (Google, Meta, hosting, CRM, analytics, email platforms, plugins). You are responsible for:

• Paying third-party fees directly
• Maintaining account ownership and access
• Complying with platform policies

We are not responsible for platform outages, policy bans, or changes by third-party services.

9. Intellectual Property

• You retain ownership of your brand assets and data you provide.
• Unless otherwise agreed, once full payment is received, you get rights to final deliverables created specifically for you.
• We may use general know-how, templates, frameworks and non-confidential learnings across clients.
• We may showcase work in our portfolio unless you request confidentiality in writing.

10. Confidentiality

We will keep your non-public information confidential and use it only to provide services. You agree to do the same for our pricing, processes and internal documents.

11. Security & Access

You are responsible for securing your accounts (passwords, admin access). If you share access, do so via secure methods. We are not liable for losses caused by compromised credentials not under our control.

12. Prohibited Use

You must not use our services for illegal activities, misleading ads, policy-violating content, malware, spam, or anything that harms others.

13. Suspension / Termination

We may suspend or terminate services if:

• Payments are overdue
• There is abusive behavior, repeated non-cooperation, or policy violations
• Work requested is unlawful or unethical

You may stop services as per the refund/cancellation policy (see the Refund Policy page).

14. Limitation of Liability

To the maximum extent allowed by law, we are not liable for indirect, incidental, or consequential damages (loss of profit, data, goodwill). Our total liability is limited to the amount you paid us in the last 30 days (or the project fee, if project-based).

15. Changes to Terms

We may update these Terms periodically. The updated version will be posted on this page with a revised “Last updated” date.
